These Terms of Service (the “Terms”) govern your use of Novaz: Food & Cosmetic Scanner (the “App”) and our website (together, the “Services”), so please read them carefully. Our Privacy Policy also applies to your use of the Services.

By using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Services.

We may revise these Terms from time to time. Changes may be posted within the App or on this page, so please check back regularly. Continued use of the Services after changes take effect means you accept the revised Terms.

The Services

Novaz: Food & Cosmetic Scanner lets you scan the barcode of a food or cosmetic product and see information about it, including a score from 0 to 100, the factors behind that score, and suggested alternatives. Our website provides information about the App and how-to guides.

Information, not advice

Scores, ratings, and diet or allergy alerts are provided for general information only. They are not medical, nutritional, or dietary advice, and they are not a substitute for advice from a doctor, dietitian, or other qualified professional. A score reflects our published method applied to the data available for a product; it is our assessment, not a statement of fact about the product’s safety or quality.

If you have an allergy, intolerance, or medical condition, always read the ingredient list and allergen statement on the product’s packaging. A missing alert does not mean a product is safe for you.

Product data

Product information comes from Open Food Facts and Open Beauty Facts, collaborative databases built by volunteers, and from products you add yourself. This data may be incomplete, out of date, or wrong, and manufacturers change recipes and formulas. We do not guarantee the accuracy or completeness of any product information or score. Data from these databases is available under the Open Database License, and product photos under Creative Commons licenses.

No manufacturer, brand, or advertiser can pay to influence a score. Scores change only when product data or our method changes.

Products you add

If you add a product that isn’t in the database, the photos and details you enter are stored only on your device and used to show that product in the App. You are responsible for the content you add and for having the right to use any photos you take.

Your responsibilities

  • You may use the Services only if you are 13 years or older and are not barred from doing so under applicable law.
  • You are responsible for your purchasing and consumption decisions and for checking product packaging where it matters to you.

Purchases and subscriptions

The App is distributed through the Apple App Store. Novaz PRO is an auto-renewing subscription. Payment is processed by Apple, and any free trials, renewals, cancellations, and refunds are subject to Apple’s terms. A subscription renews automatically unless canceled at least 24 hours before the end of the current period. If you start a free trial, you will be charged when it ends unless you cancel before then. You can manage or cancel a subscription at any time in your Apple account’s subscription settings; cancellation takes effect at the end of the current billing period.

Intellectual property

Novaz and its licensors own the Services, including all associated intellectual property rights. The Services are protected by copyright, trademark, and other laws. We grant you a limited, non-exclusive, non-transferable license to use the Services for your own personal purposes in accordance with these Terms.

Nutri-Score is a registered trademark of Santé publique France. iPhone and App Store are trademarks of Apple Inc. Product names, brands, and logos shown in the App belong to their respective owners and are used for identification only. Novaz: Food & Cosmetic Scanner is independent and is not affiliated with, sponsored, or endorsed by any manufacturer, by Open Food Facts, or by Santé publique France.

Acceptable use

You agree not to — or attempt to — do any of the following:

  • use the Services to misrepresent a product or to harass or defame a manufacturer or anyone else;
  • scrape, bulk-download, or systematically extract data from the Services;
  • probe, scan, or test the vulnerability of any Novaz system, or breach any security or authentication measures;
  • decipher, decompile, disassemble, or reverse engineer any software used to provide the Services, except to the extent permitted by applicable law;
  • interfere with or disrupt the Services, or any user, host, or network;
  • violate any applicable law or regulation, or encourage anyone else to do any of the above.

Termination

You may stop using the Services at any time by uninstalling the App. We may suspend or terminate your access, at our discretion, if you do not comply with these Terms or use the Services in a way that could cause legal liability or disrupt others.

Disclaimer of warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT ANY PRODUCT INFORMATION, SCORE, OR ALERT IS ACCURATE, COMPLETE, OR SUITABLE FOR YOUR NEEDS.

Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, NOVAZ WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING LOSS OF DATA OR LOSS OF PROFITS OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF, OR INABILITY TO USE, THE SERVICES OR RELIANCE ON ANY PRODUCT INFORMATION OR SCORE. SOME JURISDICTIONS DO NOT ALLOW THESE LIMITATIONS, SO THEY MAY NOT APPLY TO YOU.

Indemnity

You agree to indemnify and hold harmless Novaz and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or connected with your use of the Services or your violation of these Terms.

Governing law

These Terms and any dispute arising out of or relating to them will be governed by the laws applicable to Novaz, without regard to conflict-of-laws principles.

General

These Terms constitute the entire agreement between you and Novaz regarding the Services. If any provision is found unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision is not a waiver of that right.
